What sentence
11 Answers
A while ago I posted a question about what sentence a driver would get having killed my husband and being charged with driving without due care and attention.
I can now give the answer - 1000 fine and 9 points on his licence. Any comments?

Was the other driver drunk, for example? Was it just a horrible accident as a result of insufficent attention? It makes a big difference.

Holy sh1t. I think you'e going to be flooded with answers like these Mandy, but can I say how sorry I am to hear that you lost your husband in such circumstances, only to have this happen to his killer. If you believe in Divine Retribution then the driver will probably have it coming to him in the next life. I am so sorry that the legal system has let you down so badly. Cherie xx
Hmmm, i think i remember your question Mandy.
It makes you feel a lot worse when the person literally 'gets off with it'.
Unfortunately this a more common thing these days as judges seem to be lacking training/experience.
Maybe now its all over you can try and move on.
But if you have enough money and evidence to suggest otherwise, i think you can take out a private prosecution against him...

Ahh but In A Pickle, surely its up to the judges as well.
Putting this case aside (apologies Mandy) have you seen some of the recent decisions in this weeks news?
Shouldnt they take into consideration the 'sentence' the victims and their families have to go through for the rest of their lives.
I think a whole re-form of the justice system is long overdue...

Thanks everyone.
To answer a few queries - he had no alcohol in his system, he wasn't on the phone and wasn't breaking the speed limit. He lost control on a bend - perhaps in wrong gear and going too fast for that bend - CPS decided there was not enough evidence for a 'death by dangerous driving' to stick.
The charge of 'driving without due care and attention' meant it was dealt with in a Magistrates court and they have limited powers. Appreciate the sympathies.

So sorry Mandy for your loss - this is for you:
You can shed tears that I am gone,
Or you can smile because I have lived.
You can close your eyes and pray that I will come back,
Or you can open your eyes and see all I left.
Your heart an be empty because you can't see me,
Or you can be full of the love we shared.
You can turn your back on tomorrow and live yesterday,
Or you can be happy for tomorrow because of yesterday.
You can remember me and only that I've gone,
Or you can cherish my memory and let it live on.
You can cry & close your mind, be empty & turn your back,
Or you can do what i would want - smile, open your eyes, love, and go on.
