Is the spouse Responsible for the funeral cost of their spouse?

I need a little help, whom knows if it is nation wide or state related (florida for istance) If the spouse is responsible for the funeral costs of their spouse? We paid for my husbands brothers because my sister in laws Guardian (the state) has said that it is not her responsiblity to pay for those, He had nothing left sole his own, she hasnt lived in the house with him for 2 years or so. The house is left items in the house and nothing in the bank. Since they were married she gets everything but pays out nothing? I dont understand. Need some guidance.

The law might be different in the US but here in the UK, the funeral costs are paid for from the deceased persons estate:

Who pays for the funeral?

The cost of the funeral is usually met out of the estate of the deceased, if there are insufficient funds the executor is personally liable.
If the deceased has not left a Will the person arranging the funeral (normally the next of kin) is liable to meet the funeral costs.
If the next of kin is not prepared to arrange and pay for the funeral (for example where there are insufficient funds in the estate) they will be asked to make a written statement to confirm this.
