I'm in the process of buying a property and according to the title plan there is a statuatory declaration attached to the property. Can anybody explain a. what a statuory declarion is b. how it would effect the property and c. is there a way to view it on-lin.
A Statutory Declaration is a sworn statement made by an individual in the presence of a Commissioner for Oaths. It may be used in many situations, but is a legal document that can be used as evidence.
If its linked to the property the immediate thing that springs to mind is access arrangements. Has this property got access over someone else's land?
Thanks buildersmate. That exactly what the problem is there is an area at the front of the property which is not within our boundary but our path crosses.
