hi are me and my partner allowed to take his son abroad on a holiday for one week next year his son is 5 but his mom is saying by law we cant take him.

If your partner has Parental Responsibility he can take him for up to three weeks . If he doesnt have PR its not that difficult to get it. Speak to a solicitor. I believe if he is on the birth certificate he has it automatically.

He doesn't have automatic parental responsibility if he is on the birth certificate, unfortunately.

As his son is 5 years old and wasn't married to the mother, there is no automatic PR. The law changed in 2003/4, I believe?

However it isn't difficult to obtain ~ he can apply to the court, and he should be successful!
I think he has to have the mothers permission to allow her child to leave the country. We had the same with my husbands son.

hi pippa he was married to his sons mother before his son was born and was only divorced last year does this make a difference
Oh yes ~ it makes a difference!

This means he does have automatic parental responsibility and there is no reason why you both can't take him abroad for a week.

I have no idea why his ex has been told he can't. What are her objections, exactly?
