I was arrested for drunk & disorderly about 12 years ago - I was never taken to court, just spent the night in cells Do I still need to apply for a visa to get into USA now?

You are such a threat against the security of the US that they insist you get a visa. Being arrested is enough. They don't bother with the nonsense of whether a court found you guilty of the act, a rozzers word is enough.

Getting a visa will take you time - you physically have to go to the embassy for an interview - and lots of money.

There's plenty of other countries that welcome visitors.

But if I tick no in the right boxes what checks are they able to make against my name? I don't live at the same address anymore etc plus polic erecords of cautions without convictions are supposed to be deleted after 10 years

Assuming you're from the UK and are travelling to the US on holiday you won't need a Visa, you'll be issued with a 90 day [i think that's the length] tourist visa

I was arrested for the same thing about 7 years ago. Went to the states this year for three weeks with no visa.

You've admitted here for the world to see that you entered the US illegally by giving a false answer to Question B on I94-W (Have you ever been arrested...): if they read this they'll have your name on their computer and next time you'll get stopped at immigration and arrested.

Moog,the visa waiver programme isn't open to people who have been arrested.

The i94w form does not ask if you've just been arrested. It asks if you've been arrested through controlled substance or had a prison sentence for more than 5 years.
