changing name on deeds

please help me, recently my wife left me she has been having an affair,she said it has only been going on for 2 months but i know its been going on for longer now she moved out of our home 8 months ago and stayed at a friends house me and my 12 year old daughter stayed at home she came to see are daughter every day and she said to me that she needed her own space that is why she is staying away, anyway 6 weeka ago i confronted her about the other guy and she confessed,she has now moved to a rented house and said she cannot afford to pay the mortgage so i want to know where i stand legally if i pay the mortgage by myself will she be able to claim half when our daughter leaves school or will i have to get her name taken off the deeds (will be costly) thanks

All finances will normally be settled before divorce is granted. When sorting out finances etc including the mortgage. Everything will be put in the pot as they say.
Depending on the equity in the house...if there is enough money to rehouse your wife, then maybe you will have to sell to rehouse her and have a new smaller home for you and your daughter. Although this may not be the case, depends on where she is living and her situation at the time. Also bare in mind your pension can be drawn into it as well, but can be used a s a bargaining tool. Usually the courts use the process of your needs and most importally your daughters needs. Have you always paid the mortgage? There are alot of things to be sorted along the way. You maybe able to stay in the house until your daughter reaches a certain age. Then you may have to remortgage to give your wife something.Everyones situation is different. It may be a good idea to contact a solicitor for advice. Try and see one that has 30 minute free consultation. Don't panic yet there is a long way to go. Hope this helps.
