"A businessman accused of drugging his assistant during dinner and then raping her in a Manhattan hotel has admitted assault.

David Nicholson, from London, pleaded guilty to second-degree assault, admitting that he attacked the 41-year-old in March 2000.

Prosecutors said that he spiked her drink with a drug that put her into a stupor before taking her back to their hotel near Times Square. He then "engaged in sexual intercourse with (the victim), who was incapable of consent by reason of being physically helpless", according to the indictment.

Nicholson's plea was part of a deal in which he will be sentenced next month to five years' probation. It will be served in Britain, where he will be required to attend alcohol and sexual abuse programmes."

I think he can also be tried in the UK. Under the law that's used on sex tourists I believe.
It appears that he has been convicted of assault which probably wouldn't result in a prison sentence. So he is serving his sentence in the UK. I assume there is some kind of 'swapping' probation sentences, as it would be hard for someone to sign in with their probation officer every week when you are no longer resident in the country. I guess there are some countries we have this reciprocal relationship with. with a prison sentence I would rather they served it in the country where the crime was committed so that the sentence was properly served.
Mind you if I had been on the jury I would also have found him guilty of rape and would have proposed that he served life in a seedy USA jail, in that kind of impartial way that I have.

Hello Ruby,

Unfortunately, he wasn't tried for rape so you wouldn't have had chance to find him guilty of that. I think prisons should be for people who a danger to others (and this man would seem to fit that bill) and not for tv licence dodgers.
