Why are you posting this Q when you had an identical Q earlier in Motoring Rules?

I thought it was a different setion im new on here and the answers in the other section were not really of any use, What i really want is to know where i can find the exact law.
"The points remain valid for 3 years from the date of conviction but you are not subject to any further probationary period or terms as a new driver. If you reach 12 points within any 3 year period, you would be subject to a totting up disqualification, as would any other driver."

So youd be banned

you wont be able to just take test again. Even if you could afford to insure a car with 12 points you would be banned from driving it.

I'd be guided by your solicitor.
You could also visit www.dsa.gov.uk and email your question to them.
so the solicitor was correct, in a way :)
