what sentence is likely for gbh section 18 wounding?
my fiance was drunk and attacked (headbutted) by a friend at a train station.
the friend later went on to my fiance's flat and was waiting for my fiance to arrive.
When he did, my fiance did not want to let the man in after an argument, a neighbour came out and the man attacked him.
To save anymore trouble, my fiance let his friend into the flat.
whilst in there my fiance and his friend carried on arguing.
The man went on to smash plates over my fiance's head, so my fiance picked up a knife and stabbed him in his back (near the left kidney)
the injury sustained was minor. My fiance is now on remand.
The man has made a statement but insists that my fiance invited him to his flat and stabbed him at the door
and that he did not smash anything over his head.
My fiance has been charged with gbh section 18 wounding. My fiance also has previous, is he looking at a custodial sentence and if so for how long roughly

I'm sorry but to stab someone in that situation is just horrific, what was up with him just using his fists as self defence? By using the knife he's now ended up making things a whole lot worse for himself when if he hadn't it would be the other bloke in more trouble.

He is definately looking at a sentence and it could be 3 1/2 years - because he used a weapon, so it will be with intent. And also because of his previous. Has he gone not guilty, If so and the prosecution witness does not turn up he may stand a chance, but other than that he will be deffo looking at a custodial sentence (he as been remanded in custody till the trial date - so that shows they will give him a custodial sentence if found guilty). My son did nothing as bad as this and was just charged with ABH sct 47 (lesser charge than GBH sct 18). He is now serviing 2 1/2 years because of his previous. Your partners offence carries a heavier sentence even without previous.
my boyfriend is in the same situation...but hes been charged with 2 counts of sct 18...and its not looking good...my boyfriends barrister said hes looking at around 8 or 9 years which i think is a bit harsh considering its his 1st offenece but it was reali serious...it took a year for my boyfriend 2 b convicted so it was a lenghly wait, he was also up 4 trial last fri which has been adjourned untill feb...i think ur boyfriend may b lookin at 5 yrs 2 do half unless he gets an ipp..then hes ******!!!
