i want my husband to adopt my two sons . does the father have to give permission. my four yr old he signed his birth certificate but was not legitimized as father. but my three yr old he didnt sign birth certificate and was legitimized. I lost custody in 2003 but was giving it back in 2006. i was told to keep my boys away from him. I had lost my children cause of domestic violence from him. do you think the courts would give my husband custody. there father is now in prison for domestic violence against me. do i need to obtain a lawyer what should i do.

I really think you ought to see a Solicitor regarding this matter who will advise you.
I am not sure if the laws in England and Scotland are the same, but in Scotland, if your new Husband wishes to adopt your children, they you also have to adopt them in the same way, even though you are their biological Mother.
Social Work will also be involved in this and it does cost quite a bit of money.
