If so, he will be responsible for ensuring that the assets from any Will your brother has made are distributed according to his wishes and he can be sued if he does not perform this task properly. If your deceased brother did not make a Will his estate will be distributed according to the laws of intestacy, and an appropriate relative will have to apply for Letters of Administration, and the deceased's estate should be distributed according to those rules.
