My father passed away September 2007, his personal pension payment was made the same day he passed away, they are now asking for it back. Can they do this??
Can anyone help me with this please.......

If you mean his state pension then yes they can ask for it back because it is paid in advance so the payment made on the day he died would be for the week ahead.
I meant to add that my mother died the day after her weekly pension payment and I had to pay most of it back.

It was not a state pension - it was his own personal pension which he had paid into
With my pension it would be paid to my nominated beneficiaries on my death, is that the case with your Dad?
Oh right sorry, my husband has a private pension and he had to nominate someone to receive it on his death. It is usually the next of kin and sometimes it is only a percentage of the original amount.

No I was not the beneficiary, I was the executor of his will and the only child, my mother passed away several years ago.He passed away the same day as the pension payment was paid into his account, this was paid on monthly basis, I cannot understand why it has taken 5 months to let me know..........
riverlark I would get on the phone to the pension provider and get some answers. It is impossible to get any real answers on here as we do not know all the facts.

Thanks pussnboots - I will be getting in touch with the pension company this week, before I did that I was wondering if anyone else had been in the same postion
