My ex partner has summonsed me to court for contact to my 3 year old daughter, i don't want this to happen as he is violent a drug abuser and half of his family have criminal records (including him) and are on the mental health register, the are all bad influence on my daughter and therefore i do not want him to have contact with her. I am currently seeking a solicitor, based on what you have read to do think he will have any parental rights left?

For more on marking an answer as the "Best Answer", please visit our FAQ.if what you say is true i dont think he stands a chance of having any custody, however if he he pleads to the court that he will change they may allow supervised visits where he can come and see her but with you or another adult you trust about. but they will only allow this if they can see if he trying to change,
my friend was in a similar situation a few years ago, her husband was abusing her and had a criminal record. he was allowed to see his son for one hour on a saturday at a place both parents agreed on, ie the park or cafe etc. unfortunatly she started to trust him again as he did seem to have changed and always turned up on a sat but as soon as she started to get close to him, he started the violence again. she now has an injunction against him where he cant go near them.

my friend was in a similar situation a few years ago, her husband was abusing her and had a criminal record. he was allowed to see his son for one hour on a saturday at a place both parents agreed on, ie the park or cafe etc. unfortunatly she started to trust him again as he did seem to have changed and always turned up on a sat but as soon as she started to get close to him, he started the violence again. she now has an injunction against him where he cant go near them.

If contact is given there are places called contact centres.
I used to volunteer in a couple and we supervised visits from parents and other relatives in a special centre.
The children would be dropped off and we would look after them until the other parent or relative arrived, or look after they if they didn't so the parents/relatives did not have to meet each other.
Might be an idea if they give him contact and you're worried about the circumstances.

Agree with Jenna. If what you say is true, I'd also be worried about a child having contact with this person, so agreeing to meet at a contact centre'd be your best bet. If the guy pays towards the child's upkeep, then he probably has a right, in theory, to see his child, but yes, I think you need a solicitor's advice.

I have just been through a similar experience with my ex and my son
What happened with me was a cafcas officer was ordered to do a report as my ex denied his drug use and criminal record
They work on a basis that is in the childs best interest
Since my ex has been having contact with my son he has attacked me twice so I am now back in court as the judge wants to re think the contact he was allowed with my son
In my experience they only want contact with the child to get to the mother as what has happened with me he knows where I live now and I have had to get an injunction out on him again
I think the contact will be stopped now but he has abused his time with his son
Good luck with it and you will certainly get to put across your concerns regarding contact
