Any advise for an accident which happened in June. My parked vehicle was hit by an uninsured driver. The driver has agreed to pay my insurance company the cost of repairing my vehicle, and i have not had to pay any excess or suffered any damage to my ncb or premium. As a consequence of the accident i had to take two days off work, suffered a lot of stress (my house was also cosmetically damaged by the accident) and have 5 days without the use of a car. I took the time off work as holidays, and my employer confirmed to the solicitor that I was paid in full for the time i had off work. The solicitor seems to be acting in the interest of my insurer, and not in my interest. They are only persuing the claim for the repair of my vehicle. I have requested that i am paid for loss of earnings, loss of use of vehicle, stress and inconvenience and a taxi fare to collect hire car. solicitor says they will try to get payment for this, but don't think they will be able to. Would I be able to take this to a no win no fee type solicitor? would it be of any advantage to me if this claim went to court? Thank you, Helena
The kind of solicitor who would deal with this is someone who deals with ULR (uninsured loss recovery). If by any chance you have legal expenses insurance (often an extension of household contents insurance) you should contact them for advice.
