has wales gone too far ?

 surely here in Wales, this smoking ban has gone too far ? it now extends to ALL public places, ! the pavements, roads, streets, ave's, lanes, are they not public places too ? asked my youngst Son last night " if he and his girlfriend were out walking along the public footpath across the mountain area,   no one around, just the sheep and ponies, and then they come upon me, having a rest and a fag, enjoying the view , what would he do ?... " Report you dad " he said !!!! at 6' 6", 19 stone, rugby player, he's too big for me to clip around the ear .... what/where is not considered a public place ?

er, wherever its private. in other words where the general public aren't allowed. i.e. not a public place.

   the general public are allowed to stand on the pavement....... the pavements here in Wales are 'outside ' out of 2 so far, who is correct ?

Legally, a public place is somewhere that the public have access to either upon payment or otherwise.  So outside would generally be considered a public place.

Luckystrike is right. I understand (although I haven't read the government white paper) that the proposed smoking ban refers to 'enclosed public spaces'.

 

This includes (most) pubs, restaurants, offices, railway stations and the like. In this context outside (the street, hills, up a tree, on a beach etc) is not considered public.

Our house is a public place sheep wander in and out dogs and cats. Giggsy our white budgie has gone nicotine yellow with grandad on his Capstone full strenth fags. How about banning farting in public,           passive farting! nanny state!!!!

Luckystrike if outside is not a public place is it a private place, is a private road a public road then and a public road a private road? But then a public school is a private school.Hartley so if two tramps were enclosed in a large carboard box in an open public space smoking would this come under the ban.

if 2nd row is correct about the ban applying to ALL public areas then luckystrike & hartley are incorrect. If hartley & luckystrike are correct then the question was wrong in the first place.  are you sure it will extend to ALL public areas 2nd row or just enclosed spaces?

 just been confirmed that this ban does cover ALL  public places, when it comes into force no one knows yet....... much debate going on ! uproar ! apparently my question is now being asked throughout the land ! the ' news' and newspapers... no one seems to know ! and an editor ( just spoken to )confirms that it does include all public places, and eveyone has to wait til friday for further details.............. same as SYDNEY, australia, NO SMOKING in public places, not buldings etc, etc, all public places

 The Welsh Assembly here in Wales (Labour controlled ) are nothing but puppets run by those in Westminister..... we've been hit by this now proposed ban, only Wales, ......did not Maggie Thatcher do the same with her Poll Tax thing ? lets try it out in Scotland first !!!! what Scottish a/b's remember that ? same ploy again ! not one teeny weeny part of England, let Wales have it this time !, the pilot.... see what happens down there etc. etc., the rest of you have been given a  certain year date, will this total ban in all public placeson that date.... depends on we in Wales do about it, as said , the questions has already started, but Scotland put up a massive fight against the poll tax......... but it was extended to everywhere in the end......... politics, and remember, there is a general election coming up......

John Reid is Scottish and is responsible for bringing the smoking ban in, his pal in charge is Tony Blair born in Edinburgh also a Scot (this is therfore a Welsh /Scottish problem). I think the welsh Parliament  should have the same powers as the Scottish Parliament. The English should have a Parliament of its own.

We in England are organising Smoking holidays for the welsh and scottish.coaches will leave at all departures throughout wales and scotland,as soon as you cross the border into are lovely country,you may light up till your hearts content!there will be a fixed charge of �5.oo for every 20 you smoke-cheap at the price you must agree.we look forward to seeing you .England allways here to help are welsh & scottish friends.PS please bring your own ash trays!

   thanks for your offer Moonraker, funny thing is , thats exactly what has been happening here in Wales, coach loads of Irish people, wanting to enjoy a drink and a cig. at the same time, coming here ! not far , the severn bridge, so apart from the Welsh, could be the Irish, Scots too ! and to answer RODS question. ( 2 tramps, cardboard box..... ) when, if this ban takes place, ..... parks ? public place, no smokeys ! and more than likely get nicked for litter !.... debate going on now is' tis said this secondary smoking can kill the children ',,,,, and included is " that because , children are too fat, that some could die before their parents !!!!!! F********** H***, what chance have these kids got ???? nice news for them, right on top of xmas !

I was led to understand that smoking will be banned in Scotland & England first, with Wales to follow suit.  The ban applies to ALL public places, the workplace, pubs and restaurants.   Smoking will only be allowed in your own home and in what are referred to as "Private Members Clubs."   Good thing too, why should i be made to suffer because of someone elses desire to poison themselves with toxins??  And for everyone who is going to say "well, you have non-smoking & smoking areas in pubs & restaurants, you don't have to sit with the smokers," i say does the smoke realise that there is a divide?  Does it get to a certain point and think "hang on, mustn't cross the invisible line, that'll mean that the non-smokers are going to be passive smoking?"  DON'T THINK SO!!  I'm all for each to their own and all that, but what about my right as a non-smoker to choose NOT to breathe someone elses poison and possibly live 20 years longer?  Old hat, I know, but surely even smokers have to admit that this is a valid point?

Just re-read your question 2nd row, and realised that it wasn't really asking for opinions on the rights and wrongs of whether we should / shouldn't smoke, etc.  Sorry everyone, got carried away on a bit of a tangent!!  (You must admit, though, that is a valid point!!!)

Wales are going to be hit the hardest regarding this ban... sort of ' try it out first down there,  i have no doubt tho, that cometh the date given to England ( is it 2006 or 7 ? ) it will be made final there ..... perhaps good news for you non smokers, but tonights paper, 83% in favour of ban, ( in all public places ) which means everywhere, except from them clubs etc, 17% dont want this rather harsh ban...... you could be the other end of town, i could be miles away, sitting alone in a park, and still not be allowed to have a cig,  because the park is a public place,,,, england will be hit with an almighty crime wave ! cos ALL your police will have be down here to enforce such a ban,,,

Hang on, have I missed something? The last I heard was some Labour no-mark on HTV news last week, saying that the assembly will be allowed to ban smoking in all public places if it wants - I hadn't heard anything about a decision being made yet.
