My fiance worked for a company down south last year for about a month. When he was on his way home he realised he had left a bag with clothes etc plus a his new digital camera in his boss' car. After phoning him, and his boss agreeing to send up his bag we waited. Nothing arrived and after MANY phonecalls it was finally disclosed that the bag had been "thrown out". Firstly, not even sure to believe that but since then (Aug) my fiance has been phoning and trying to get them to replace it and nothing. Someone is never in, or call back, or the big boss isnt in until Monday and call back then. These are a list of the useless excuses. My fiance is quite a patient man but im beginning to get fed up with this. Friday there he phoned again and was told to phone today to speak to the MD but again this guy isnt in until later today. Does my fiance have a case here?

I take your Fiance doesnt work for this firm anymore? If he does, then filing a small claim may not be the best career move???
If you wish to pursue this legally then your F needs to write an official letter to the MD of this firm stating they have 14 days to reimburse you for the items they negligently lost. ( enclose reciepts etc)
Explain that you made a verbal agreement with the boss for the bag and it's contents to be sent to you, ( with you paying for the postage) and this agreement has been broken by an employee of his company.
Explain that you will file the necessary forms with the County Courts and initiate a small claims proceeding if they to act within the 14 day period.
That should do the trick
