I hope somebody out there can help.
My Partner's ex-husband is refusing to give her any money what so ever towards the upkeep of their 2 children(ages 6+11). Now the complicated bit!!!
Some 18 months ago he was involved in an accident in work but has now been declared fit to work again, he is working 37 hours a week so my partner was advised to go through the C.S.A for mainenence for the kids. But they have said that he doesnt have to pay a penny because he is claiming industrial injury benefit, which he is legally allowed to do and work at the same time. How can this be right or fair ?? he is bringing home �300+ a week with wages and benefits but yet doesnt have to pay a penny for his 2 kids. Is there another way of leagally making him pay maintenence?? Any help would be greatly appreciated, Thanks

For more on marking an answer as the "Best Answer", please visit our FAQ.Thank you all for your replies, aaccoording to the C.S.A becuse he is claiming industrial injuries benefit this cancells out what ever he earns, be it �300 or �600 a week, while he is claiming this certain benefit he doesent have to pay a penny for his kids. ojread2 the percentage is only quite small something like 15% there really is nothing wrong wiith him(apart from being a Prat) I cant understand anybody who coukld have 2 kids and not want to help with their upkeep how ever small the amount
My daughters Ex. has several businesses which he owns they have 2 children, she has custody. He was ordered to pay an amount monthly to her never did pay. Owes �13.000. Just bought top of range 4x4, yet admits to having an income of less than �100. The income tax believe him as do the Family Support. Is this or your case examples of justice. Best of luck.
