I have recieved a letter from a city parking company demanding that I pay a fine for a ticket that I did not receive. They are adamant that it was issued - any ideas on my rights here?

i got one ticket in a shopping centre car park for staying too long. I paid it the next day. I got a letter a couple of weeks later saying that i hadnt paid the one which had been stuck to my windscreen a week before the one i had to pay for. There was no ticket ever stuck on my car apart from the one i had already paid for. They say I will still have to pay for it or court procedings...So what?

To be a valid ticket it must contain the following information; ticket reference number, vehicle reg no, vehicle make and colour, location, date and time of offence, attendant/warden no, contravention code & description and penalty including early settlement discount. If the ticket is a fixed penalty notice FPN then it has been issued by a traffic warden or police officer and you will have little recourse. However if it is a penalty charge notice PCN this will have been issued by a local council parking attendant and if the information listed above is incorrect in any way you should appeal politely in writing to the adjudication board for the council who issued it.

As a piece of advice, if you ever get done for being late back to your car, simply wait for the next motorist to come along and ask for their ticket. If it is still valid for the time of the ticket issued wait until you get the penalty notice then send a copy of the NEW ticket and say the attendant must have mistakenly not noticed your ticket. You'll get off every time.

Question the decision and ask to see a copy of the ticket. Don't believe people when they say you can't get away with it. I challenged them and guess what ...i won. No penalty to pay and an apology to boot.

Cheers Hattster - did they threaten you with bailiffs and court action? I was parked illegally - unknowingly - and did pay a fine i got a week later. I just didnt get a ticket for the first time they are claiming.
Yes i was threatened with court action, baliffs, you name it. Just tell them to go ahead, that you wish it to go to court. They soon change their mind. Infact i demanded them take me to court for which they promptly backed down. Don't be scared of their heavy tactics and threats....thats how they do their business, stand up and be counted.

You could also try asking for any photographic evidence of the ticket placed on your car,

In some towns the parking people routinely take photos of the ticket on your windscreen or as evidence to show you were parked illegally. Also checkout the signage where you parked to see if there was some indication that where ypu parked was illegal
