an ex partner is trying to register a unilateral notice on my property for a beneficial interest which I am contesting. He is also alleging that I obtained my mortgage by fraud (which is a lie and can be proven). Should I inform my lender of this notice as well as the allegation of fraud, if I did inform them would they have to get involved with the dispute. thanks
any inhibition attached to your property would automatically be registered with the title deeds and with your mortgage provider. I would inform them of this move as failing to do so may affect your contract with them. They may also wish to be involved with any action that may arise as if this involves you, as they may be libelled as joint defendants/respondents. If you are going to defend the action you should consult a solicitor and get his expert opinion.
