X Sister in Law Common Assault on her own child aged 8?
What are the penalties for common assault by a monther on her own child?
She currently has the 4 children during the week and my brother has them at the weekend - court order.
She has been charged with common assault on the 8 year old. Where does this stand now with regards to her having the children during the week, or at all come to this! The two eldest are currently with my brother since the assault, the two others are currently still with her, not sure what is happening yet as this only happened on Wednesday late afternoon.
Surely she should not be allowed to keep the children after this????

Yes, you should wait and see whether she is guilty or not.
A couple I kow have recently split up and their children (who were monsters before the split anyway) are causing all kind of problems. The eldest (12) wasn't told he couldn't live with his dad which he wasn't happy about and so to 'get back at him', he went to school and told the teacher his dad beat him up, which he hadn't. This obviously had to be investigated and caused all kinds of problems.
So just because the child says something, doesn't necesarrily mean its true.

Child protection is always a serious issue and the child should always be listened to as the authority.
It should always remain that the child is believed until it is investigated.
Unfortunately, some children use the great resources that have been put in place for their protection to their own ends.

My child went to great lengths to cause disruption and doubt into the lives of not just myself but the rest of our family.
I never hit any of my children (I have four) but after my child had hit me and elbowed me in the nose whilst laughing, I decided I wasn't going to put up with her bullying behaviour anymore.
I slapped her across the face after she had done the same to her younger brother because he "annoyed" her. I did this in front of people so she would finally see that I wasn't afraid of her or what she could say.
I honestly do not condone violence in any way but do not regret what I did. Yes it was common assault against a minor but could I have pressed charges against her for slander when she was telling people her step-father was injecting drugs or when she was saying I was beating her and her brother? Could I have pressed charges against her for attacking me on the many occassions she did?
There may be many things you do not know about her behaviour at home and what led up to this incident. She may be totally out of order but maybe needs some help that she is too proud to ask for.
You don't state the circumstances which is fair enough as it may be too personal but this is too grey an area to give a definitive answer.
