my x partner and i own a property in joint names, when we separated he offered to buy my share of the house but, then lost his job through redundancy, and told me he could not afford to at the moment,as it was my fault the relationship broke down i told him he could pay me when he got a job, that was 8 years ago, i have tried on numerous occasions to contact him but, he won't see me let alone talk. as far as i know the property is still in joint names, have i lost my right to a settlement

If you are shown as joint tenants, then in view of the fact that your ex now ignores you send him by recorded delivery a notice saying that you unilaterally severe the joint tenancy which will then convert it to a 50/50 tenancy in common. In the same notice say that you now intend to sell your half of the tenancy in common (his agreement is not required). You do not need to concern yourself about expenses as mentioned above, as he owes you rent for living in your half of the house and one will balance the other. It does not matter at all that you were responsible for the break up. The value of your half share is calculated on present day values. If you are not used to doing legal things yourself you should really employ a solicitor.
