NIP Driving without due care and attention
12 Answers
A fortnight ago i totally misjudged how much room i had to turn left and caused a cyclist to brake, I did not hit the cyclist, but when looking in my mirror saw that she had fallen from her bike, i parked up got help and went back, she was gone,on walking back i saw her asked if she was ok, she was shaken with grazes to hands and knees, she told me that i should drive more carefully and got back on her bike and rode away, i have now recieved a nip, what happens next, I am normally a careful driver and all this has made me ill, resulting in needing medication, I just need to know what happens next and how long does it take

From your account you were involved in a reportable road traffic collision. You complied with the first part of the road traffic act by stopping, but I guess from your account that you did not report it to the police. As there was an injury, you have to report it to the police if not immediatly then certainly as soon as practical and within 2 hours. A notice of intended prosecution has to be sent out within 14 days fro certain road traffic offences - driving without due care and attention is one of them.
You will now likley be contacted by a police officer to attend for an interview (you will almost certainly NOT be arrested) but the interview will be under caution. Depebding on what witnesses there are, what you say on interview and what the police conclude happened will dictate if you receive a summons or not for the offences. If ou want to spped thinbgs up, then contact the officer named on the NIP and offer yourself for interview.

Unless their were independent witness, then it's one persons word against another.
I doubt if you will even be prosecuted. Give it a few weeks and you will get a note saying so.
If it does go further, then just turn up at court and plead guilty. You will most likely be offered a course.
If you are , then take this option.
It costs about 200 and means a couple of days off work.
However no points or fine.
Don't worry about it.
My Brother in law is road traffic police and family liason. some of the tales he can tell.

Have been interviewed under caution, police told me not to worry i would not have to go to court it worse case would be points and a fine...... on friday i get a summons to attend for driving without due care AND failure to stop and give details, i think this is harsh, i would put hands up to undue care, but i did stop, admittley i drove down the road about 200 yards got my husband and walked back to see her, details were never asked for she got back on bike and rode off see orginal question, help what should i do, i am prepared to take undue but not the other what happens at a magistrates court do i have to attend is it open etc
