Time ago I took out a contract with Orange for 18 months. When that period was almost over I got a call from them to talk me into upgrading and I said yh sure give me a new phone then stupidly. Now some 7 months later I realised I dont really need a contract but have been informed by them that ill have to cough up some serious money if I wanna get out. Now this was merely a renewal over the phone rather than the first term of 18 months where I actually signed a contract. I know that written terms will always prevail the intentions of either party but in this case surely there are no written terms at all as it was all done over the phone.
My question is can they hold me to the new period without me having signed anything??

I take it they advised you that you would have to enter into a new 18 month contract in order to get the new phone. Did they just send you one or did you have to go into a branch to pick and/or collect one?
You have carried on with it for 7 months without a problem, it's only now because you want to get out of it you have raised an issue.
The amount required to get out of the contract will, of course, reduce as time goes by. Depending on the minimum amount you are contracted to pay monthly x the remaining 11 months you should be able to guage when you will be able to afford to pay off the outstanding amount.
