Hi. I answered an advert selling a mobile phone and sent a postal order by recorded delivery for the phone. The seller emailed me to say he had received postal order and would be sending phone next day. That was over a week ago and phone hasnt arrived. I emailed seller and he said he posted it first class but not recorded delivery so we cant track it. I assume phone is lost in post so is there a chance I could get my money back or does the seller have the right to keep money as he has a receipt of postage? Thanks

I am assuming you have purchased this through something like ebay? 

Check the listing again and see what the seller said about posting, did they say it would be recorded?

How much did you pay for the phone because I think up to a value of �25 you can claim back off the Post Office.  Is the feedback for this seller good?

If this person has a proof of postage can you ask them to send you copy so you can pursue the Post Office.  If not, I would contact the auction i.e. Ebay and ask them to investigate.  Normally does the trick!

Hi. Thank you for reply. No, phone wasnt purchased from ebay. It was from www.freeads.net so advert is no longer on there. We agreed that I would pay �5 for postage and �100 for phone by email so the only proof I have is that I can prove he got postal order from me and I have 2 emails from him. One email confirms that he received postal order and another confirms he posted phone. The seller has never ignored my emails so I have no reason to believe he has done a runner with my money and not bothered to post phone. Just wondering where I stand if phone doesnt turn up. Thanks

first class is insured but only for a small amount like �25 and even then trying to get royal mail to pay up is similar to all them men trying to pull excalibur from the rock!!!

I think that a call to royal mail is whats needed but i wouldnt hold your breath about getting the phone or money back, especially if the poster as a receipt for posting your item, as he can blame royal mail for the loss

Ask him to send the proof of postage so you can take it up with the post office (maybe by recorded delivery so the proof doesn't get lost). Ask your post office to check it out (he may have got a proof of postage that has been changed etc). At the end of the day you are unlikely to get your money back but try anyway, and try to get some money from the post office.
Something similare happened to me and Royal Mail refused to deal with me as I had not sent the parcel (even though it was mine).  The sender had to claim the money back and forward it to me

I am sorry this had happened to you. The seller should be resposible, he should have send this item through special delivery which should cover the cost if it gets lost, and he charged you �5 for postage, thats just...
How do we know he did really sent it...!!?? Ask him for proof of postage and point out is his fault the item is lost. The chance of getting your money back would be very slim, but at least try.
