ok .. very delicate subject. after 7 years i had a DNA test and found out that my son was NOT my son... even tho i love him too bits his mother has made it impossible for me to continue to play the father part in his life.. with regret i wish to take my name off the birth certificate and also want to reclaim all of the maintenance payments i have payed over the last 5 years since the divorce... can anybody give me some advice to see if this is possible...A GUY IN NEED OF ASSISTANCE
Im so sorry to hear of your predicament. Finding out something like that must be awful especially as you love him so much. He will still probably regard you as his father so I hope your relationship with him stays ok. Good luck
If you love the boy why are you wanting all the maintenance payments back? If the mother has to repay them she will suffer financially,so will the child. She may not deserve and sympathy but surely the child does!
You can't claim the maintenance payments back - there is an assumption of legitimacy for a child born in wedlock and the Children Act allows maintenance to be claimed for a child who has been treated as a 'child of the family', even where the DNA proves you are not the biological father.
