i have been paid 3.44 too much for 80 weeks at work totaling 252. now they say they want it back even though i highlighted it to various managers at the start , and then just let it roll . my question is do i have to pay it back as it was there mistake to pay me in the first place
Yes you have to pay it back and the fact that you yourself highlighted you were being paid money you weren't entitled to all along means you can't really plead ignorance and ask for time to pay with any real validity. Which is not to say they won't be receptive to collecting over time regardless of course.
Previous two answers are correct but in addition remember that your employers cannot simply deduct the amount overpaid from your next salary payout. Make an offer to pay back in equal instalments at the same rate you were over paid. At least if you saved the money you have the advantage of interest.
If you can prove "they" made the mistake then yes you should be reimbursed however if in a contract you agreed to something else then this COULD be your fault .
my example i could give you would as of a result in a union victory.
I won but be prepared
Yes, to put it quite plainly, you will need to pay it back, but you can at least ask for ways and means in which to do so. Let me please also advise that if you fail to pay it back then you could risk prosecution for a criminal offence of theft. Sorry to appear so blunt, but that's the law.
Hi,
Hope you've managed to sort this by now but this is my experience
I had this happen to me to the tune of nearly 900. I looked into it and all the info I came up with said that they could claim it back. My employer did take all the tax and NI into account and accepted what I offered to pay, 25 but they did first ask if I could afford 50. They also agreed to deduct this 25 before any tax or NI taken off.
