Can someone tell me what is the difference in law between Threatening someone and telling them?
Is there an 'act' which explains this?

Whether you scream at somebody or tell them calmly is irrelevant, if that is what you are getting at.

It is the Criminal Justice and Public Order Act 1994 that covers it:

This defines a criminal offence of intentional harassment, which covers all forms of harassment, including sexual. A person is guilty of an offence if, with intent to cause a person harassment, alarm or distress, s/he:-

uses threatening, abusive or insulting words or behaviour, or disorderly behaviour; or

displays any writing, sign or other visible representation which is threatening, abusive or insulting, thereby causing that or another person harassment, alarm or distress.

in my experience they can get away with that tetjam. even if they add "shame if anything happened to them"

Ethel, a person told their manager something in a quiet voice and the manager took it as threathening. the manager got the person escorted off the premises but was told to come back the next day. 6 months later the person was dismissed for Gross misconduct. If it was such a bad thing he done on the day surley they should have told him not to return. I need to find out if HR was at fault for letting the person continue working. Any info on Gross misconduct should it be an instant dismissal ? Is there Any official paperwork to back this up. thanks

If a manager is bullying by shouting which caused a reaction. Then is it then still classed as misconduct to the employee. Or are both parties wrong?
