Dangerous dogs act

If someone took a rotweiller into a crowded pub , and then the dog broke free of it's leash , caused a panic , but did not bite anyone . Has any law been broken ?
Or perhaps no harm done .

The Act applies only to four types of dog and crossbreeds of those dogs:

* Pit Bull Terrier
* Japanese Tosa
* Dogo Argentino
* Fila Brasileiro

So the Act does not apply to Rottweilers

That's secion 1 and 2 of the act.

Section 3 reads:
3 Keeping dogs under proper control (1) If a dog is dangerously out of control in a public place�
(a) the owner; and
(b) if different, the person for the time being in charge of the dog,
is guilty of an offence, or, if the dog while so out of control injures any person, an aggravated offence, under this subsection.

And the 1997 ammendment reads:

4A Contingent destruction orders (1) Where�
(a) a person is convicted of an offence under section 1 above or an aggravated offence under section 3(1) or (3) above;
(b) the court does not order the destruction of the dog under section 4(1)(a) above; and
(c) in the case of an offence under section 1 above, the dog is subject to the prohibition in section 1(3) above,
the court shall order that, unless the dog is exempted from that prohibition within the requisite period, the dog shall be destroyed.

Jake - the Act does only apply to those four breeds of dogs (Section 1)and the Act does allow the Secretary to State to add more (Sectin 2) but that hasn't happened yet.

Section 3 and subsequent sections relates to the breeds in Section 1

Apologies, Jake - further investigation shows:

Section 3 of the 1991 Act created a new offence of being an owner of a dog of any type or breed which is dangerously out of control in a public place or a non-public place in which it is not permitted to be

So the key is 'dangerously out of control' and not just loose.

I think that the rotweiller breed should be put on the Dangerous Dogs Act. I mean, how many stories have there been about these dogs attacking people. Ok, maybe they've been rasied correctly, but they've still got that instinct to attack. I know all dogs have that instinct, but the majority of the stories we hear in the papers are rottwieller attacks.

You hear about rottweiler attacks because they make good news,there are probably many more attacks weekly by other breeds and mongrels but they just don't often make the news.

Sorry for going off the subject a little, but I'd like to tell you about my in-laws' dog (now sadly no longer with us).

Each Sunday they went to the same pub for Sunday lunch, and Shane (hugh alsatian) would sit underneath the table where they ate (I'm going back a fair few years here - it wouldn't be allowed now!)

Anyway, he used to have an ashtray full of beer each Sunday (again, I know - not wise, but he loved it and it was only the one ashtray full).

Anyways, one Sunday he'd had his ashtray of beer, and he stood up, sending all the dinners and drinks flying. The landlord banned him on the spot.

He was a lovely dog, god rest his soul.x
