I damaged my knee 3yrs ago when i slipped on a wet floor and i have been having problems everyday since.I tore a ligament and chipped a fragment of bone.My leg was put in a cast for 2weeks and i had phyiso.nothing helped and it is getting worse as tme goes on. I seen a specialist 2weeks ago and he said i had cartalige damage and said i would need synvise injections and i would get arthritis v.soon in my knee. The special also said it might be genetic,even though my other knee is perfect and so was the bad knee before the fall.my family has no record of any problems with there knees.Iam not sure weather the specialist knew i have been visiting my own gp regularly complaining of my bad knee. How would this stand up in a court if a specialist says its genetic and the fall triggered it off????? the place where i fell is claiming liability. thanks for your help................

I honestly wouldn't hold out any hope. For one thing, there is the ability to be able to prove negligence, and as I found out earlier this year when I wanted to make a claim, that isn't so easy as it might seem. Oddly enough, my knee too - I am a postman and was off work for three months following an accident in a supoermarket.

Secondly - as I also was told - there is a time limit involved to make a claim and I suspect you are beyond that.

The best I can advise is that you try calling one of these accident claim lines - if you get nowhere then I would say there really isn't a chance unless you are prepared to risk your own money, and you'd probably be advised against that.

You have to start a claim for personal injury compensation within 3 years of the date of the accident, so you may be too late.

You say the place where you fell is claiming liability? Do you mean they are admitting liability - they are saying it was their fault?

If your specialist is saying it could be genetic, then that would have significant bearing on any compensation you were awarded. You would have to prove that wasn't the case, and you can be sure the other side's specialist would make that very difficult.
