Drink driving

I got caught drink driving last night after works xmas do (yes I was an idiot) - 51mg at roadside, 42mg and 43mg at station. They offered me the option of a blood test which I accepted. It took about an hour for the doctor to turn up. One of the officers said I may be lucky and get a negative result as it took so long and i was just on the limits anyway. Anyone had negative blood tests? I've got to stew now for up to six weeks, my job is on the line as i have to drive, I'm also disabled (can't walk too far) so this may have a massive impact on my life.
Also, I'm worried if I do get convicted that it may breach my 3yr conditional discharge that I was given about 18 months ago for false representation - basically got I more housing benefit than I was entitled to. Can anyone shed some light please?

Blood tests should normally be quicker than 6 weeks - I hope you were offered one sample for your own test (which you should do).

If you are negative, no worries. If you are positive, you are, unfortunately, looking at a ban. Although given your circumstances you may be able to argue exceptional hardship. You really need legal advice given the impact it will have upon your life.

As for your conditional discharge, if you are over the limit, you will have to admit being in breach of your CD, but it is quite likely that the magistrates will take no further action on it - it being a totally unrelated offence.

Unfortunately, on here benefit fraudsters and drink drivers attract nothing but vitriol, so be prepared for the outpouring of vituperative remarks that this post is likely to attract.

there are NO circumstances that will get you off a ban if your test is positive,and quite truthfully mate you deserve to be banned,drinking and driving over the limit is against the law,but seeing from your past you have no respect for the laws of the land,it might do you good to get banned,then next time you might think before you commit another crime.

Thanks for your reply Barmaid - see what you mean about the other posts! People should think twice before twisting the knife - talk about kicking a guy when he's down! You don't know me or the circumstances surrounding the CD offence. I have worked all my life and paid my dues just like next man. The disability and CD are linked to a serious RTA which meant i was unable to work for 3 yrs. I hope you never have to navigate the complex benefit system - its a minefield and so easy to fall foul of the law. And by the way elephant man, the monies I so called 'ponced' of you have been paid back in full. Some people make a living from benefit scams - I ain't one. There are also reasons why I chose to drive but i don't wish to go into that here.
I don't want or need sympathy. I offer no excuses for drink driving i was wrong, **** happens and i will accept my punishment. I only wanted to see what I'm up against.

And by the way it would wise for some of you to remember the saying 'let he without sin cast the first stone' or are you the first 'perfect' human beings I've come across on this planet?

But you could have killed someone! Yes, we alll make mistakes and none of us are perfect. I'm sure we all break the speed limit now and again and behave like idiots sometimes. But, some things are not acceptable in any circumstances - drinking and driving being one of them. I am very surprised the PC said you might be lucky - most PC's love to nick a drink driver and see them convicted. However, you didn't kill anyone, so try and see any ban/fine/loss of job as less of a punishment than blood on your hands. Harsh I know, but it really could have been much worse for you.
