My father has just died. He lived with his partner 32 years but they never married. What claim does she have on his estate.

For more on marking an answer as the "Best Answer", please visit our FAQ.She can make a claim under the Inheritance (Provision for Family and Dependants) Act 1975 for reasonable financial provision for her maintenance. By the sounds of it, she will be elligible under the act as a co habitee having lived as the wife of your father without actually being married for a period of 2 years ending with his death. The Court will certainly consider that 32 years is extremely persuasive. However, there are a number of other factors that will be taken into account. This claim has to be issued within 6 months of the Grant of Representation.
