hit from behind in puegeot

Hi

My girlfriend was hit from behind last night when she was waiting to turn right into a road, and the other driver said it was his fault, when i got there i got him to write on a bit of paper and sign what had happened and he did saying he was looking at something and was distracted, my question is firstly her mot ran out 2 weeks ago, will she be covered?? both cars are written off, also she has hurt her neck and back, can she sue? plus the air bag in the puegeot didn't go off but she was hit from behind so is this why it didn't go off?? any help would be great, my email is

I can't see why she cant sue him, and claim on his insurance for the write off of the car, however there may be a problem because by driving without an mot, she has probably invalidated her insurance (get het to check her policy, on mine it says you have to be legal to be covered), and these sorts of proceedings usually go through the respective insurance companies.  Regards to the airbag - there could be a number of reasons it didnt go off, one of which being a mechanical fault that may have been picked up on mot perhaps?  i would think it's most likely that it was because it wasnt head on collision.   Lastly, the admission you mage the other driver sign, i dont think counts for anything at all

Sensors for the airbag would have been in the front, that is why it did not go off! as for the MOT, the insurance will be void, the car should not be on the road, you are illegal! also you are breaking the law if you did not report it!
