Executor of a Will how do i get out of it

hi my sister has tricked me into being the executor of her and husbands will. she told me its just in case they both die etc. but i dont wont to do it as what ive read its a complete pain in the ass.so how do i get out of this before its too late?

One way to avoid having to do it would be to ensure that they die after you.

You don't have to get out of it now.

When the time comes you can just decline to act, either turning it over to a solicitor or leaving someone else to apply to be substitute.

It's never too late.

If you find yourself as an unwilling Executor, you can simply "renounce probate" ... ie give notice that you will not be doing it.

Tell your sister that, if you find yourself as Executor, you will simply renounce probate, and she will be left with ne Executors. This should persuade her to change her Will, and appoint someone who is actually willing to take on the task.

Just out of interest, how exactly did she trick you. Did she lie about it or maybe ask you when you were not paying attention or possibly you were just too stupid to understand what was being asked of you.

If she reads this she'll want to change the will anyway. An executor has to be someone you trust implicitly to carry out your wishes in an exemplary manner - I don't think you'll qualify!! I gave a great deal of thought to the matter before approaching 2 people (1 a relative and 1 a close friend) and was very grateful when they agreed to be executors after thoroughly going through the processes involved. I had to be sure of things because it involved the possible care and finances of my young daughter. So it's certainly not something to be 'tricked ' into or taken lightly.

you do not have to act as executor. If the time comes that both are dead then you just take the will to a solicitor and tell them to deal with it. I was the executor of my fathers will and I am for my mother. It is no big deal. I just took the will to my solictor, she dealt with all the benefciaries and gifts, sorted out the house ownership and it took about 6 months. The bill was reasonable and came out of my fathers estate. hope this helps.

im the forth child of six and my mother has asked me to be the executor of her will when she dies,i was sad but she knew out of all of her kids i would do the right thing about everything there is to do and to carry out her wishes.my dad has azlzimers ,so already im helping make decisions,and helping her,its nice to know they feel they can trust you .so do the right thing and tell your sister now.
