my mother gave me a gift of 5000 pounds a few months ago we have had a fallout and she now said she whants the money back as she now says it was a loan and is threatining legal action can she do this

She will have to prove it was intended as a loan. Such proof is a contract signed by the two of you, or proof that have made regular repayments.

Without proof she has little chance of winning.

But maybe as it's your mum you should offer to pay back something, maybe in instalments.

make up with your Mum, you've only got one and when she's gone you'll miss her. Sort the money out later.

I agree with Carmalee. I was unfortunate to lose my mum when I was 18 (and my dad at 21) and I would give anything to see them again. U only have one mum and money is really not worth it.

You clearly had a very good relationship before because she gave you the money in the first instance.
