Section 8 Eviction
Courteosy of the local council causing havoc with our housing benefit claim we are due to attend court from any point next week. We have made several complaints against the council as the whole situation could have been avoided and I shall be suing one department for defamation of character (for reasons I cannot go into on here).
Does anyone have experience of this matter, if so please get back to me as soon as possible?

But experience of what? You haven't given any details of the way in which the council have messed up your housing benefit, nor any details of the complaints you have made, or any reason you intend to sue a council department for defamation of character. All that can be gleaned from your question is that you expect to shortly appear in court with regard to an eviction order. I'm afraid that without some clear details it wouldn't be possible to answer your question. Sorry though about your predicament.
I assume youre being evicted from a private tenancy because the Local Authority has not paid your Housing Benefit, is that right?
If so, how many months rent overdue are you? If less than 2 months then the s8 wont succeed. If you are more than 2 months overdue can you pay off some to get it below 2 months before the hearing?
Have you also been issued with any other notices, an s21 for instance?
