question on neighbour building conservatory

My neighbour has started building a conservatory. I cannot see directly what they are doing but judging by the noise it sounds like they are constructing it on my house wall. Are they allowed to do this without my permission? What if they damage my house?

No of course they aren't but unless you actually go and have a look, you won't know will you.

They definately need your permission if they carry out any work on property belonging to you so ensure that you go straight over there tomorrow and find out what they are doing and get them to pay you a boat load of money for doing it or report them to the council!

I would ask them politly first, you never know you might just be wrong.

They would have to have served you with a Party Wall Award prior to the work commencing. I would also imagine they would need planning permission or at least Building Regs. If they have not served a Party Wall Award and you did not sign an agreement then you can legally stop them from doing any more work by taking out an injunction until such time all paperwork is in place.

Party Wall Act? - maybe - but only if they are working right up to the boundary.
Planning Permission? - probably not - it depends what size / orientation / Conservation Area etc.
Building Regs? - not unless the structure is > 30 square metres in floor area, or they are removing the external doors of the existing house that lead into the conservatory.

Party Wall Act notice would be required if ththey are building to within 3metres on the boundary
Get your solicitor to write to them asking them to reveal what they are building
Get Surveyor to advise on their plans and check if Local
authority file
