Parental Responsibility - while it's being processed

Hi there,

My husband has applied for parental responsibility for his daughter. His ex wants to take his daughter on holiday which is fine by us but we think she wants to renew her passport and change the name on it too (to her current boyfriends surname).

My question is this - we have submitted our request for parental responsibility to the courts and want to know if she can apply for a passport in a new name while the request for PR is going through the courts. Our worry is that she's going to get the passport and change the name before the court gives parental responsibility and my husband is able to stop it...I'm worried we might be too late.

does it really matter what the name is? If your hub get PR, then he will have decision making powers anyway, no matter by what name the child is known as. if he was married, he'll have auomatic pr anyway

also meant to ask, has the childs name been changed officially anyway? cause if it hasn't they wont be able to get a passport in any name except whats on the birth cert anyway

Bizarely we don't know what his daughters surname is at the moment - how ridiculous. The ex says she's changed it but won't show us any proof so who knows? It makes me so sad that someone can change your own childs name and you have no say. No, they were not married so he def doesn't have PR (the child was born before 2003).

Our issue is that she is applying for a new passport now - but our papers have been with the court since end of last year so I wanted to know if she is able to submit the application form with the new surname while the papers are with the court - I was sure I read somewhere that you can't apply for a new name while a request for PR is with the courts.
