car crash
hi all i just revesed in to a bmw my falt i no. but he was parked on double yellow lines. will my insurance pay out. or was i in the wrong. after all he should not be parked there.

This sounds terrible and I would like to stress that over the last 24 years I have learned to drive properly.
In 1985 I was 22 years old and I had a part-time taxi driving job. One day I hit a Maxi up the back while it was parked on double yellow lines outside a small shop. I was an inexperiencd youngster and I just wasn't watching. Mercifully, the driver was in the shop as I was doing 40mph in town and I completely squashed the Maxi - and they were built like tanks! I was driving a Mercedes W123 and my bonnet was buried in the Maxi as far as his front seats with his tailgate up to my windscreen! When we pulled the cars apart the Merc (also built like a tank) wasn't even scratched and I just had to pop the spring-loaded Merc badge upright again!
When the gasping Maxi owner came out of the shop and walked up the road to where I had transported his car I told him he was on double-yellow lines and I thought he was moving. That was also what I put down on the taxi company's insurance form and I later heard the Maxi owner's company had paid out as he had to admit that he was breaking the law.
Perhaps the law has changed now but the decision went in my favour as I said I thought he was moving. I details of your prang are different kawa but maybe you could press the fact that the BMW was breaking the law.
I would like to say that I'm rather ashamed of this event and I'm certainly not proud of the memory. However, no other harm was done and the experience was one of those that enabled me as a yougster to mature into what I now hope is a safe and responsible driver.
