Two computing terms fit the blanks for the first one: "scareware" (small free programs designed to encourage prospective marks to install other software from the same source, and which turns out to be carrying trojan horse code; these have no license/clickwrap for obvious reasons) and "shareware" (copyrighted, unwarrantied, free or cheap software which is often misconstrued as being "in the public domain" [technically *quite* different]).
