my 12 year old
daughter has not seen her biological father for three years he has not bothered she now states she wants something legal done to divorce his rights as her dad if you like . there was a history of severe domestic violence against me including an incident whilst i held her as a baby, can she have his rights terminated as she wishes??

For more on marking an answer as the "Best Answer", please visit our FAQ.If her father hasn't bothered for 3 years, I wouldn't worry too much. What rights has he got? if he attempts to fight for contact, her feelings about it would be taken into account by the authorities/courts at her age anyway.
Not sure on the law regarding removing all parental rights other than adoption, but maybe you should have something in place in your will regarding guardianship should (God forbid) anything happen to you.

My daughters father had access twice a week, she refused to see him from the age of eight because of things i wont go into. Similar to urself, When she was twelve she decided she wanted him access although no attempt wasmade by him to excerise it stopped on paper to make her feel safer. She could not use the same solicitor as i had used due to a conflict of interests, They advised her that by raising this he might fight it and open up something that had lain dormnt for four years, She still went ahead with it and had his rights to acess every again removed. It made her feel empowered which was great for her after what had happened. This was under Sottish law
