Driving With Out Due Car And Attention..
Hi..
I need a little advice on a matter that happened last week, i was reversing in my car around 2mph if that, and i slightly tapped a person, and fell, there was no injures etc..
the ambulence had checked the person, and he was fine
the police had come, and never even spoke to me, looked at the scene and went off again
the reason behind tapping the person was, i was in a car wash, for some reason he was behind my car, he had dropped his fone, and was picking it up, hence why i never saw him
i had recently brought the car, so it was not in my name, a NIP has been sent to the owner, and i sold the car a few days later, (part time trader) so the car is again not in my name
why would the police send a NIP, when there was no injuries? and they never spoke to me at the time?
they are also asking for docuements, producer type details
any advice would be great, thanks

the car had tax, and it also had mot, all the tyres were legal etc..
but why would they send a NIP? there was nothing i could have done, the idiot was behind my car, when there was no reason to be so, he was getting his car washed, and should have been on the side, i have whitnesses to say he was picking up his phone, and i had a passenger in my car, who also saw nothing
what is the outcome for this?

If it was reported to the police - either at the time or later, they have to act. As bednobs says, whether there were injuries or not is irrelevant. If a complaint has been made they must investigate. They have to find out who was driving the car, and all relevant details. You must reply with this info.
Is what you've been sent a summons, or merely an NIP? At the moment, the police will only have one side of the story. They need yours. Only when they have all details can they decide if anybody will be prosecuted.
Don't fret about it, just give them the details - and back it up with your witnesses. If all you say is correct, that'll be the last you hear of it.
It occurs to me that this character might be trying it on, in the hope of getting an insurance claim out of you.
Good luck

hi again
yes everything i have said is correct to the most minor detail
there is no video evidence as theres no cameras facing this way
and witnesses are there, one in the car, and of corse the car wash guys
its just, ive got 9 points atm, for stupid things, and ive recently, became a car trader, and this would just stop me in my tracks! im only 22, ive had my lisence for 3 years though
and yes mate, it is just a NIP that has been sent, one page asking for the driver of the cars details, and another page asking for stuff such as insurance etc..

Whether you face prosecution or conviction is difficult to say.
However, if you are convicted you will be awarded a minimum of three points and thus face a minimum six month ban under totting up.
One thing you cannot rely on is the private land angle. Although it may be owned privately the pub car park almost certainly falls under the definition of a public place for road traffic act purposes.
