I own my own retail business. My shop and the premises next door are both A1 retail. Next door is supposed to be a sandwich/coffee shop. Their lease specifies that no cooking is allowed on the premises and they have been told such by our/their landlord. Fatty smells emanate every day into my shop to which I have recently had to close on occasion because I cannot clear or mask the smell. I've called environmental health at the local council to no avail, spoke time and again with my landlord who assures me that he has sent letters to the tenants next door reminding them that they are in breach of their lease. This has had a detrimental effect on my business as people have ventured into my shop only to walk back out saying it smelt "fatty". What am I to do? I myself do not even lunch on the premises.
The loss of business and just the smell alone has caused myself ill health. I am at my wits end and do not know where to go from here! Any assistance greatly appreciated.
Environmental health was one angle you could have tried.
A second angle is now planning - it is not permitted to use a premises with A1 planning permission for another A class (can't remember offhand what class retail involving cooking counts as). So try contacting Development Control (planning) at the local council.
