Divorce and Joint Mortgage
My friend has recently gone through a divorce and the court ordered her husband to sell the matrimonial home and for her to receive half of the money from the sale (it was a joint mortgage).
She recently received a letter from the solicitor stating that her husband has moved to Scotland, and because of this, he is no longer entitled to pay her the money because Scotland is under a different jurisdiction.
He hasn't actually moved to Scotland - he's still residing in England (whether this is unknown to the solicitor, I don't know)
So, is it true that if he moved to Scotland, he wouldn't be entitled to giver her her half of the money?
Is ancilliary relief unenforceable if he moved aswell?
