ebay rights and wrongs?

hi a friend of mine put a bid in for concert tickets yesterday and her offer was accepted, as the show is tonight she has arranged to exchange the cash for the tickets upfront in about 3 hours from now. She bought 4 of them at �160, 1 for herself and 3 for work collegues, only she is now saying she cant afford them afterall and is concidering not going to meet the gentleman. Personally i think she has a moral obligation to honour her promise, afterall where is he going to find someone to buy them at such short notice now????? If this was done to me i would be furious and i told her that, which has resulted in her being ina strop with me and ignoring my calls. Can she be taken off EBAY for this?

I know that a purchase is considered a contract but sellers are usually amenable if you contact them to explain problems.

However, I agree with you on this occasion that she is morally obligated to purchase them. If she didn't have the funds she should not have bid.

The seller will not be able to resell at such short notice.
and if I was the seller I would also be furious.

What ebay will do I don't know as I have never done anything like this myself.
she could at least email the seller so they have a chance to "second chance offer" them to someone else

sadly you cant get banned from ebay for not going through with a purchase.

I suspect that the worst ebay would do is to give the buyer a warning.

She should at least have the common decency to contact the seller now and explain her problem!

In theory the seller could sue your friend in the Small Claims Court for the money if he is left at a loss. Whether the seller would do that I don't know, of course. If I were the seller I would be very tempted.
Yes, the seller can take the buyer to court and would also win. This would result in a County Court Judgement for your friend (though if it were paid within 30 days this could be taken off).

I have successfully taken someone to court (and won) for exactly this reason.
As the rest said, she should at least let the man know and maybe he can get them sold outside the venue? Why leave him standing like a plonker waiting, when he may still be able to recoup some dosh! Tell her to phone / contact him ASAP, he may still have others to whom he can sell.
A friend of ours (the buyer) did something similar on ebay.
He had a paypal account,and ebay(and paypal,which are the same thing) deducted the amount lost from his paypal account,and repaid the seller of the tickets (which of course were by then, valueless).
This of course would only work if your friend has a paypal account,if not then I agree the seller should sue her in the Small Claims court.

thanks for your replies guys i was starting to feel that i was perhaps out of order for saying what i did to her, but i know i ws right in what i aid now. From what ive heard now she did go and meet him afterall but only bought 2 because 2 girls from work backed out last minute saying they didnt think it was a good price!
