my daughter as been assaulted

my daughter has been getting bullied in school by this girl the school knows about this i've written letters to the school ' but after this my daughter was down the town and this girl has walked up to her calling her a gypo (we are from the travelling comnunity) then she pushed her up against the wall grab hold of her screaming abusive language at her saying racist comments to then ended up to spitting in her face my daughter is 14 this girl is 15 a year above her in school (the same school) i've reported it to the police and they said they might charge her with section 39 ,we have some of it on her friends phone recorded as evidence to , what will this girl get done to her by the police

I don't agree with that law but at least it can provide some people with a attempt at justice.

If you have not already done so, request to see the head of school and ask for a copy of their policy on bullying.
You state you have written letters to the school, have you kept copies? you need to build up evidence and communication and keep every thing.
Follow the schools policy to the letter and at each stage have a one to one meeting with the head then ask what they will do next and follow it through with them (time scales etc)
In the mean time record all incidents if your daughter has any and take photos if applicable.
Don't back off and make sure you are totally happy and understand each stage and if you need to be a 'pain' then so what.

Sadly, having removed corporal punishment from schools, bullying has shot up simply because teachers have no effective form of control over these minor miscreants.
Blame the do gooders whose philosophy is that we should "understand" why the thugs act as they do rather than protect victims by punishing offenders.
Until common sense prevails, the situation will continue unabated.
