why is it that not my solicicitors or barrister told me that if i took it to crown the case would get thrown out because theres no proof or & lack of eveidence. ok crap solicitors & barrister.....i always thought solicitors & barristers would do there job properly. i dont think thats fair..........So if you have no knowlegde of law you can get sc----d by your own solicitors.

Errr, if the charge is common assault it can only be heard by a Magistrates. If I have understood your previous post, you have been found guilty by a Magistrates Court. Consequently, they must have been sure of your guilt to convict.

You can appeal to the Crown Court, but there is no guarantee it will get "thrown out". The case will be a rehearing of the case in the MC, and if the Judge and two lay magistrates are sure, they will also convict and your appeal will have been unsuccessful.

I cannot see that your legal team have done anything wrong.
Throughout your (many) questions on this topic you keep telling us there is no evidence against you.

From what you said in an earlier question you have been convicted by the magistrates so there must have been some evidence to support the allegation. When the magistrates announced their verdict, they would have outlined the evidence they heard, what they believed and what they did not. Many charges involve the word of one person against another�s. Each person's "word" is evidence which can either be believed or dismissed. That is why the magistrates are asked to make a decision.

As Barmaid says, an appeal does not guarantee success. It simply involves three different people hearing the same evidence. They may well draw the same conclusions as the original Bench did. It will also cost you around �500 in court costs should you fail.

only eveidence there was,Was a pair of broken glasses.which i didnt break Worth �200 so she says.there was a witness saying that she saw me 1 hour before the comon asault &criminal damage crime took place.saying i was shouting & really ****** off.which is not true.cctv everywhere in the shoping centre.im sure a camera would of caught me doing what witness said.Apart from that,witness didnt see the alleged comon assault & criminal damage. which supose to have taken place 2 miles away from her shop.I was there but i never did slap m x behind her neck causing glasses to fall,then i was suppose to of steped on them.Which is totally not true.I always thought show me the proof that it was me.Oh cctv all around estate as well.but cctvs been lost.
