garden fence problem

my neighbour has put up a fence on the boundary without asking or telling us. should he have informed us and can we paint the side that is now on our land ?

He didn't have to inform you if it is on his land and if it is then no, you can't paint it or attach anything to it.

Whose land is it actually on? I'm sure it can't be directly on the border.

there is a small gap between our two houses and the fence looks like it is right down the middle, it is an extension to an existing fence.
What do yours and your neighbours deeds say? you can get these online from land registry for about 5 or 6 pounds each.

This should tell you who is responsible for the boundries.

If they are shared (which nowadays is more unlikely) then he should have got your goahead or at least informed you. If they are his then out of curtesy he should have informed you but doesn't have to. If it is your responsibility then no he shouldn't.

Either way he would need your permission to come onto your land if he needed it to errect it.
