Was the cheque returned marked Refer to Drawer or Refer to Drawer, Please Represent?
If it is marked with the former it means you are very unlikely ever to see your money.
Are we talking about a small or large sum?
In theory you could take the person to the small claims court but it is only worth doing if you are substantially out of pocket.
Why would the person who banked the cheque incur any bank charges? You shouldn't withdraw the funds until it is certain that the cheque has cleared and you won't get charged just because the chq has bounced so I don't understand why you have incurred a charge?
