Handing in notice after maternity leave

Hello, I am currently on maternity leave and am due to return to work on 11th December. This will be the end of the 39 weeks paid leave and also an additional 10 days of holiday that has accrued.

However I have been refused flexible working hours (have checked with Acas and thay confirm the company reasons for this are acceptable) so I have no option but to leave and seek part time work elsewhere.

My contract says I have to give one months notice of resignation - do I hand this in on 1st November to coincide with end of maternity leave on 1st November or do I hand in on 11th November to coincide with the accrued holiday??

Thanks for any help

accrued holidays are not counted in with notice, so you just obey your contract, so if your due back 11thdec notice should be given 11th nov.
I'm not sure about this - I'm sure when I had maternity leave I had to go back to work for 3 months before I could make any changes to my contract or hand in my notice to justify my employers paying maternity pay.
