I changed my son's name by deed poll about 5 years ago. It cost �23.00, although i had never been married to his dad i still asked him if he minded out of politeness but would have done it anyway even if he hadnt wanted me to. Although his original surname cannot be changed on the birth certificate you will get an official change of name deed that states he/you (cant remember which) has relinquished all use of his former surname. You must keep the deed along with the birth certificate as yuor daughter will need both when filling in anything legal or applying for bank accounts etc.
I changed my son's surname without his father's consent by statutory declaration in 2001. It costs me �5 and five minutes at the solicitors. His school records, health records, passport and all other official documentation (except his birth certificate) now bear my (our) surname. However, we were not married. I don't know how marriage would affect the situation as your husband will have automatic parental rights I would presume - whereas my child's father did not apply for them.
